1. Acceptance of Terms

Commonwealth Swim & Tennis Club ("Organization") provides this website ("Service") to you, subject to the following Terms of Service ("TOS"). The Organization reserves the right to change the TOS or discontinue this Service at any time and without notice. When using Service, you shall be subject to any posted guidelines or rules applicable to the Service, which may be posted in the TOS.

2.1 Member Information

The Organization stores the following information in this Service about members and their family members: first & last name, birthday, address, email address(es), and phone number(s). Protecting a member's privacy rights is important to The Organization. The Organization does not supply/sell/lease this information to any other organization. This information is used and/or displayed under the following security levels:

2.1.1 Public Access

The website restricts the general public from viewing address, email address(es), phone number(s), and birthdays. A member's name may be disclosed if the person is a leader or point of contact for a community.

The Organization is not responsible for member information stored in the contents of documents, announcements, event descriptions, acknowledgements, et cetera

2.1.2 Authenticated Member Access

Members who authenticate by password are permitted to view first name, last name, address, phone number(s), email address(es) of the other members of The Organization through online directory and through calendar events, announcements, acknowledgements, et cetera.

An Organization member may request that their personal information be removed from the website.

2.2.1 Photographs

The website communities have different privacy levels for photographs. In general a photograph may end up display to the general public. Only an authenticated community leads may post photographs.

User passwords are one-way encrypted in this system and The Organization cannot decrypt them.

4. Member Obligations

In consideration of your authenticated use of the Service, you represent that you are at least 18 years of age. You also agree to: provide true, accurate, current and complete information about yourself and family). If you provide any information that is untrue, inaccurate, not current or incomplete, or The Organization has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, The Organization reserves the right to suspend, terminate, and/or delete your account and refuse any and all current or future use of the Service (or any portion thereof). The Organization is concerned about the safety and privacy of all its users, particularly children. For this reason, parents of children under the age of 18 who wish to allow their children access to the website must create a Family Member with associated user id and password.

5. Member Conduct

The Organization does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is potentially offensive, indecent or objectionable. The Organization is not liable for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service. You agree to not use the Service to:

You acknowledge that The Organization may not pre-screen Content, but that The Organization and its designees shall have the right (but not the obligation) in their sole discretion to refuse or move any Content that is available via the Service. Without limiting the foregoing, The Organization and its designees shall have the right to remove any Content.

You agree that The Organization has no responsibility or liability for the backup, deletion, restoration, or failure to store any Content in the Service. You acknowledge that The Organization reserves the right to disable accounts that are inactive for an extended period of time or who The Organization membership has expired. You further acknowledge that The Organization reserves the right to modify these general practices and limits from time to time.

The Organization reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that The Organization shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

8. Termination

The Organization reserves the right to terminate your user account, password and all related information, files and content associated with or inside your account (or any part thereof) at any time at The Organization's sole discretion.

9. Links

The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because The Organization has no control over such sites and resources, you acknowledge and agree that The Organization is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that The Organization shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

10. DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE ORGANIZATION EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
The Organization MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

A SMALL PERCENTAGE OF USERS MAY EXPERIENCE EPILEPTIC SEIZURES WHEN EXPOSED TO CERTAIN LIGHT PATTERNS OR BACKGROUNDS ON A COMPUTER SCREEN OR WHILE USING THE SERVICE. CERTAIN CONDITIONS MAY INDUCE PREVIOUSLY UNDETECTED EPILEPTIC SYMPTOMS EVEN IN USERS WHO HAVE NO HISTORY OF PRIOR SEIZURES OR EPILEPSY. IF YOU, OR ANYONE IN YOUR FAMILY, HAVE AN EPILEPTIC CONDITION, CONSULT YOUR PHYSICIAN PRIOR TO USING THE SERVICE. 11. LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT The Organization SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF THE ORGANIZATION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.

12. EXCLUSIONS AND LIMITATIONS

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF SECTIONS 10 AND 11 MAY NOT APPLY TO YOU.
